I am writing on behalf of the West Lothian Trade Union Council and the concerns we have about the treatment of EIS Branch Official and Safety Rep, Kevin Scally. Kevin is an experienced lecturer who delivers courses at the college, he is the only employee to have been made compulsory redundant. Edinburgh College has already reached its target of £6 million in savings through voluntary severance so we can only assume that Mr Scally's dismissal is due to the fact that he is a trade union representative.

 

Despite the colleges Avoidance of Disputes Procedure, you have so far refused to meet with trade union representatives and further refuse to hear the EIS Branch grievance against this compulsory redundancy. This is a clear and egregious decision which undermines the above procedure and relations between the college, members and trade unions.

 

This has caused Kevin and his family undeserved stress and shows the college management in appalling light. It also shows a lack of professionalism and a clear misunderstanding of the role of a trade union representative.

I am writing to express concerns brought to my attention about the treatment of EIS Branch Official and Safety Rep, Kevin Scally. Given that Edinburgh College had already reached the required £6m savings through voluntary severance, that Kevin is an experienced lecturer who can deliver courses the College needs to be covered and he is the only employee to be made redundant, there are significant  

 

concerns about the reasons why Mr Scally was sacked and whether this is related to his role as a trade union representative. There are concerns that the College’s actions here conflict with the Scottish Government’s ‘no compulsory redundancy’ guidance and Fair Work convention. I have also heard concerns about the lack of meetings between yourself and union representatives, particularly considering the College’s Avoidance of Disputes Procedure. I have also heard that you failed to recognise the EIS branch grievance lodged to oppose any compulsory redundancy.

 

I urge you to meet with the EIS-FELA branch representatives to discuss a resolution to this dispute, which would avoid substantial disruption to the delivery of further education in the area going forward.

I am writing on behalf of FBU members in Scotland to express our concern at the recent treatment of EIS branch official and health and safety rep, Kevin Scally.

I am assured that Edinburgh College has already reached your target of £6 million of savings through voluntary severance, however despite that Mr Scally has been still been dismissed against his will.

 

To dismiss an experienced lecturer who can deliver courses the college needs to be covered and additionally to be the only employee to be made redundant, it is difficult not to conclude that Mr Scally's sacking is aligned to his role as a trade union representative.

I am deeply concerned by reports that you refuse to meet with EIS representatives under the college’s Avoidance of Disputes’ Procedure to discuss this matter and additionally that you also refused to even hear the EIS branch grievance against this compulsory redundancy.

The stress this will have undoubtedly caused to Mr Scally and his family will not be lost on any of us. In your roles as senior managers within an education institute providing a public service charged with delivering education to working class adults our members would expect full engagement with the recognised trade unions in such a process, and express deep concerns as to the rationale for active union officials to be seemingly individually targeted in such a way.

 

We urge that you reinstate Mr Scally immediately and fully engage with his trade union to resolve this matter.

Your staff and student body are rightly ashamed of such treatment meted upon them, and this is echoed by tens of thousands of union members across Edinburgh.

Having already met your £6m savings target through voluntary severance I can draw no other conclusion than the sacking of Mr Scally is due to the fact that he is a Trade Union Representative. It is alarming that you refuse to meet the Union’s representatives under the College’s Avoidance of Disputes Procedure. Further alarm and consternation is warranted by your failure to hear the EIS grievance against this compulsory redundancy contrary to the fundamental right of Trade Union recognition. This is an intolerable situation that should be resolved now by reinstating Mr Scally immediately. Further to this I advise you not to take a head in the sand approach when it involves personnel. The word Management has a clue to its origin in dropping the t on the end “ manage men” or to be more PC in the world of woke “ manage people “. If you have difficulty in managing especially in an Educational environment I would be willing to give you both information and guidance as to changing to a more suited career path.

We want to express our significant concern at the treatment of EIS Shop Steward, Kevin Scally. Given you had already reached your required savings through redundancy packages we can only assume Mr Scally's sacking was wholly due to the fact he was a union representative.

 

The Scottish Government, unlike their counterparts in Westminster encourage good working relationships between employers and unions and the actions taken by Edinburgh College is totally contradictory to this. I also note you are failing to recognise the Grievance lodged on Mr Scally's behalf. Trade union recognition is a fundamental right, and the attitude of Edinburgh College management is both Victorian and draconian.

 

NHS Lothian utilise Edinburgh College and I know spend significant sums of money with you regarding training for our apprentices and other staff. I am so appalled at your unwillingness to meet with the union representatives in an attempt to resolve this issue that I intend writing to our own Board (of which I am a non-Executive member), asking them to re-consider their relationship with Edinburgh College. This lack of respect for the union and their right to represent their members is something that simply doesn't exist in NHS Lothian.

I cannot even begin to imagine the distress currently being felt by Mr Scally and the apparent lack of care and compassion shown to him by Edinburgh College management is reprehensible.

Scottish Hazards is an occupational health and safety charity providing advice and support to workers who are not in trade unions.

 

Our aim is to ensure that everyone enjoys healthy, safe and fair work, regardless of where they work, or whether their workplace is trade unionised or not. The further education sector in Scotland has a crucial role to play in making our workplaces safer and healthier, particularly for younger workers starting on their careers as well as embedding the right to enjoy fair when they enter the world of work. It is disappointing that we feel compelled to write to you to as a further education establishment. We would have hoped Edinburgh College would embed fair work at the heart of your employment practices although this does not seem to be the case.

 

As Chair of the Board, of Edinburgh College appointed by the Scottish Government we would hope you were committed to the Scottish Government’s aim of a sustainable economy with fair work as its foundation by the year 2025. We would question any such commitment going by the treatment dished out to Kevin Scally EIS-FELA Branch Safety Representative, making him subject to a single compulsory redundancy, for which the college will not disclose the reasons. As a health and safety organisation who fully understands the vital role trade union safety representatives play in keeping workers safe it is disappointing that we can only reach the same conclusion as the EIS, the assumption that this redundancy, after securing £6m of savings through voluntary redundancies is as a result of his role as a health and safety representative.

 

What significant difference will the compulsory redundancy of one committed lecturer make to the economic future of Edinburgh College? We are not sure there is an answer to this question as cost savings do not appear to be the motivation on this occasion.

Fair work demands that employers provide workers with an effective voice, as a trade union recognised workplace the EIS and other unions provide this. Our view is that fair work also requires the employer to listen to the voice, Edinburgh College management appears to be failing in this regard.

 

Fair work also requires employers to provide security in employment, yet Kevin Scally has had his employment security ripped from underneath him, at a time when there appears to have been no requirement for either voluntary or compulsory redundancies.

Fair work workplaces are respectful, Edinburgh College have failed to Kevin Scally with any degree of respect, this failure to be respectful also applies to the EIS as a result of your refusal to enter into constructive dialogue to resolve the situation. Fair work employers provide fulfilling work. Most people enter teaching precisely for the prospect of professional fulfilment, obtained by passing on skills and knowledge to others . Fulfilment can be undermined by unreasonable employers who fail to act in good faith towards their employees and trade unions. Fair work employers provide opportunities for everyone. This fair work dimension states attitudes, behaviours and practices signal and reflect the value placed on fair opportunity. Kevin Scally has had his opportunity to access work taken away without any explanation, perhaps reflecting the value being placed on fair opportunity and fair work generally in Edinburgh College.

 

Not only does your treatment fly in the face of fair work, your unwillingness to meet the EIS under established procedures to seek resolution, or to recognise the EIS branch grievance in opposition to any compulsory redundancy appears to be an indication on the part of Edinburgh College to undermine existing agreements and accept that trade union recognition is a fundamental right.

 

Scottish Hazards would ask that Edinburgh College enter discussions with the EIS FELA local association with a genuine and mutual desire to resolve this situation.

So we can only assume Mr Scally's sacking was due to the fact that he is a trade union representative.

Shockingly, you refuse to even meet with the union representatives under the College’s Avoidance of Disputes’ Procedure. You also refused to hear the EIS branch grievance against this compulsory redundancy. Yet trade union recognition is a fundamental right.

The stress this has caused Kevin and his family can only be imagined. Your behaviour as managers of a public service charged with delivering education to working class adults has been appalling.

 

We urge that you reinstate Kevin immediately.
